How to File for Contested Divorce
In Oklahoma, obtaining a divorce is a relatively simple process. The eligibility requirements for divorce in the state include residency. At least one of the spouses must have been a resident of Oklahoma for a minimum of six months preceding the filing of the divorce.
Just like with uncontested divorce, the contested divorce process starts with either spouse filing a divorce petition. In an annulment or legal separation proceeding, the spouse filing is called the "petitioner" while the other spouse is known as the "respondent." Anytime there is a dispute, the contest is brought before a judge for a final decision. Negotiated divorce agreements are considered legal when accepted by a judge.
How Long Does It Take to Get a Divorce in Oklahoma?
The quickest route toward getting a divorce is an uncontested one based on an “incompatibility of the marriage” that both parties agree to. If the divorce is based on one of the spouses’ seven specific grounds for divorce, the duration will likely be closer to 10 weeks. This is because the court needs to fully evaluate the specifics of the situation when determining whether these ground are positive.
After the divorce petition is filed by one spouse, the other spouse must be legally served with copies of the paperwork to notify them about the action. If a spouse has a waiver, a service waiver may be signed, allowing the process to start or continue.
In an uncontested divorce, the other party will usually sign a waiver, which shortens the process to the required waiting period of 90 days in Oklahoma. This is tallied from the filing of the petition to the time it's finalized by the court. The filing cannot happen for the initial 10 days after service.
For a contested divorce, the waiting period can be longer. The longer the divorce is open, the longer it will take to finalize the end of the marriage. Those who have children going through a contested divorce should factor in the extra time because of court-imposed requirements for continuing education classes on parenting and other family tasks that go into the journey toward a divorce.
Keep in mind: Legal separations generally don’t allow for remarriage unless they’re converted to an absolute divorce at a later date. Discuss your situation with us to learn more about this timeline.
